1. Scope
These General Conditions apply to all contracts relating to the letting of guest rooms The Bank, holiday accommodation/guesthouses for lodging, ODEVAERE-Eekh 1, ODEVAERE-NG. 94, ODEVAERE-NG.96, ODEVAERE-KAT.OO1, ODEVAERE-KAT.OO2, TINY 1, TINY2, WHISTLER concluded between Odevaere bv (Be 0555751897)], acting as management company of the rental accommodations, and third parties (Guests).
In addition, these conditions cover all additional services and supplies of Odevaere bv, collectively referred to as the Residence Contract.
2. Bookings
By making a reservation, the guest expresses his wish to enter into an Accommodation Agreement. Upon availability of the reserved room, the guest will receive a reservation confirmation from Odevaere bv. By accepting the guest's reservation, an Accommodation Agreement arises between Odevaere bv and the guest.
Odevaere's room offers are non-binding and subject to change. Odevaere Bv reserves the right to refuse the formation of a Accommodation Agreement at its sole discretion.
There is no guaranteed right to stay overnight in a specific room.
Odevaere BV reserves the authority to set industry-specific restrictions and standards, such as a minimum stay, booking guarantee or deposit requirements for specific dates.
The minimum age for making a reservation is 18 years, which requires a valid ID with passport photo. Persons aged between 18 and 20 travelling without a guest aged 21 or over must obtain the accommodation's prior consent.
The maximum occupancy for a room is 2 guests, with the exception of one child under 10 years old. For rental houses, the maximum occupancy is 4 guests, with the same exception for a child under 10 years old. In the case of tiny houses, the maximum occupancy is 2 guests, with a similar exception for a child under 10 years old.

3. Cancellation rules
A guaranteed booking exists when the guest confirms payment for the overnight service by providing his/her name and surname, (phone number, credit card number). A guaranteed booking can be cancelled free of charge up to one month before the arrival date, GMT +1 Brussels, quoting the booking number via mail or via the OTAs (online travel agencies) or via the PMS (property management system) of Odevaere bv.
Between one month and 14 days before the arrival date, GMT +1, a cancellation fee of 50 % applies.
From 14 days prior to arrival, the cancellation charge shall be the full amount of the booking and Odevaere bv shall be entitled to the agreed payment less any costs incurred.
In the event of a 'no show' (i.e. an uncancelled reservation by a customer who does not show up) following a reservation for accommodation for which a payment card has been provided as a guarantee, the establishment shall charge the customer, as compensation, the amount of the entire stay with the payment card provided as a guarantee at the time of the reservation. In case of prepayment, the amount debited from the service at the time of booking includes the total amount at the time of booking (including applicable taxes) and, if applicable, the prices of the options selected by the customer,

4. Prices of accommodation and other prices
The prices applicable are those published by Odevaere bv at the time the contract is concluded. These prices are gross total amounts, including all statutory taxes, charges and surcharges. However, they do not include local taxes, which guests must pay themselves in accordance with the relevant municipal taxes.
In case of changes in the level of taxes, fees or levies, or introduction of new taxes, fees and levies not known to the parties at the time of agreement, Odevaere bv reserves the right to adjust prices accordingly.
5. Terms of payment
Full payment for the reserved accommodation service is required from the guest in advance, no later than on arrival. Set-off by the guest is not allowed, unless it is an undisputed or legally confirmed claim.
For online payments (by cards, wallet, etc.), the following cards are available which are listed on the payment page of the site: Visa and MasterCard, American Express, Maestro and Bancontact. This list is subject to change.
6. Options for using reserved rooms
Booked rooms are available to guests from 3pm on the day of arrival (check-in) and until 11am on the day of departure. (check-out).
Upon request and subject to availability, it is possible to agree a later departure time (late check-out) with Odevaere bv in advance. If Odevaere bv agrees to a late check-out, a supplement may be charged for the extended use of the room. For departures after 3pm, the full daily rate will be charged. It is important to note that there is no contractual right to a late check-out.
7. Resale
The resale, re-letting or transfer of reserved rooms is only permitted with the prior written consent of Odevaere Bv. Furthermore, the transfer or sale of claims against Odevaere Bv is not permitted. In such cases, Odevaere Bv reserves the right to cancel the reservation, especially if the guest has provided untrue information to the third party regarding booking details or payment. The use of the hotel room for purposes other than overnight stay is strictly prohibited.
8. Liability of Odevaere.
Odevaere Bv
accepts liability for damages resulting from injury to life, body or health, for which it is responsible. In the event of faults or defects in Odevaere Bv's services, following notification or immediate complaint by the Guest, Odevaere Bv will endeavour to remedy them. The Guest is obliged to take reasonable measures to assist Odevaere Bv in resolving the fault and minimising the damage. The Guest must also promptly notify Odevaere Bv of the possibility of unusually large damage occurring. Odevaere Bv is liable according to legal provisions for items brought along. The claim lapses if the Guest does not immediately notify Odevaere Bv of the loss, destruction or damage of the brought object.
Odevaere Bv bears no responsibility for the loss of cash, securities or valuables.
The guest is obliged to report any damage immediately, and in the case of obvious damage, before check-out. Claims against Odevaere Bv are generally time-barred within one year after the legal expiry date. This provision does not apply to claims for damages or other claims arising from injury to life, limb or health, and/or as a result of gross negligence or wilful breach of duty by Odevaere Bv.

9. Termination of housing agreement
Odevaere Bv reserves the right to terminate the Accommodation Agreement for valid reasons. Such valid reasons include but are not limited to (i) In case of force majeure, unforeseeable events independent of the will of Odevaere Bv, but also in case of simple exceptional circumstances, Odevaere Bv has the right, without any compensation for any reason whatsoever, to place the customer in another accommodation located in the Bruges region of at least the same star rating. Odevaere Bv endeavours to inform the guest of this as soon as possible; (ii) Booking rooms or spaces with deliberately provided misleading or inaccurate information, or failure to state essential facts, such as the guest's identity, financial standing, illegal use of internet services, or purpose of stay; (iii) Reasonable grounds for Odevaere Bv to believe that the provision of the service could jeopardise Odevaere Bv's proper operation, safety or reputation with the public, without being due to matters within Odevaere's control or organisational scope; (iv) The illegal purpose or reason for the stay; or (v) Resale, re-letting and/or transfer of the accommodation in breach of the provisions of clause 7.
10. Vouchers
Operator vouchers are valid for one year from the date of issue and only applicable for a stay in the specified accommodation. Residual vouchers remain usable within the same hotel. Vouchers cannot be returned, resold, transferred or exchanged for cash. Not applicable to online payments. The recipient of the voucher is responsible for the accuracy of the data. Cancellation is possible within 14 days of receipt by letter, fax or e-mail.
11. Accessibility for guests with disabilities
Odevaere Bv's accommodations are not suitable for guests with physical disabilities (no lift).
12 Food and drink purchased off-site.
The consumption of food and drinks bought outside the hotel is not allowed in the public areas. You can have breakfast at Coffeebar Adriaan, A Willaerstraat 7, 8000 Bruges, (Wed/Sun). Preparing food in the rooms is not allowed. However, preparing food in the houses is allowed.
13. Smoking ban
Accommodations at Odevaere are non-smoking. Smoking is prohibited in both public areas and rooms. Violation may result in Odevaere Bv requesting a compensation of EUR 60.00 from the guest for specific cleaning costs and possible loss of income due to the unavailability of the room. The compensation amount may be adjusted based on additional damages provided by Odevaere Bv or demonstrated by the guest to be lower.
Smoking is prohibited on the outdoor area of Coffeebar Adriaan, disturbing guests visiting Coffeebar Adriaan.
14. Pets
Pets are not allowed in rooms at The Bank.
In holiday homes, guesthouses, ODEVAERE-Eekh 1, ODEVAERE-NIEU. 94, ODEVAERE-NG.96, ODEVAERE-KAT.OO1, ODEVAERE-KAT.OO1, ODEVAERE-KAT.OO2, TINY 1, TINY2, WHISTLER, 1 pet is allowed. Guests must inform Odevaere Bv in advance of their intention to bring a pet, its breed, size.
Odevaere's approval is conditional on the pet being under constant supervision, free of diseases and not posing a risk to other guests or staff.
A surcharge of EUR 15.00/stay applies for pets, except guide dogs or similar assistance dogs for the blind and deaf, which are allowed free of charge and may accompany the guest at all times.
Pets are allowed at Coffeebar Adriaan.

Why do we process this data?
We process the identity and contact details of our customers, clients, their employees and other valuable contacts so that we can perform the agreement with our customers. We also keep a record of when and how we communicate with our clients. We carry out this processing for the purpose of customer management. This processing is necessary to perform the agreement with our customer and enables us to make a stay in our hotels as pleasant as possible.
✓ Financial administration We process identity and invoice data to keep our accounting and billing up to date. On the one hand, this processing falls under legitimate interest, namely the ability to keep our records and obtain payment for the services we provide. On the other hand, Odevaere Bv has a legal obligation to keep accounting records.
✓ Maintaining our customer relationship Odevaere bv wants to maintain its customer relationships. Therefore, we use contact data to keep you informed about our activities or to invite you to events. Sending such mailings to our customers falls under legitimate interest and is also in the interest of our customers. You can always unsubscribe from such mailings.
✓ Direct marketing Odevaere BV processes the identity and contact details of potential customers for direct marketing purposes. Processing contact data of potential new customers is part of our legitimate interest.
Access by and transfer to third parties Odevaere Bv does not sell your data to third parties and only provides it if this is necessary for the performance of our agreement with you or to comply with a legal obligation. These recipients of your Personal Data may only use this data for the execution of the agreement between you and us. They do not have the right to use the data for other purposes. If we engage third parties to process your data, we will ensure that these parties provide adequate guarantees regarding the protection of your Personal Data.
Duration of processing Odevaere Bv will not retain your Personal Data for longer than is reasonably necessary for the purposes set out in this Privacy Statement.
Confidentiality and security Odevaere undertakes to take all reasonable steps to ensure that your Data is protected by technical security measures so as to prevent, where possible, misuse, loss, unauthorised access, unwanted disclosure and unlawful alteration.

As part of our identification obligation, we may ask you for a copy of your identity card. We will respond to your request as soon as possible, in any case within 2 weeks.
- Right of access and correction You can contact us if you want to know what Personal Data Odevaere processes about you and for what purpose. You can also request us to correct incorrect Personal Data or amend your data. B. Right to deletion and restriction You have the right to request us to delete your Data. Odevaere may retain certain data after your deletion request, for example because we have a legal obligation to retain the data for a certain period of time. If you have found reasons to do so, you may ask us to restrict the processing of your Personal Data. This could be, for example, because you dispute the accuracy of your data.
- Right to object You may object to the processing of your Personal Data in a reasoned manner if such processing of your Personal Data is based on our legitimate interest or falls within the scope of fulfilling a task of public interest or an official authority.

- Right to withdraw consent If the processing of your Personal Data by Odevaere Bv is based on your (explicit) consent, you have the right to withdraw this consent at any time. However, withdrawing your consent does not affect the lawfulness of the processing before you withdrew your consent.
